一、取保候审期限是多久?

人民法院、人民检察院和公安机关对犯罪嫌疑人、被告人取保候审最长不得超过十二个月。

在人民法院二审期间，犯罪嫌疑人羁押期已经超过一审法院所判处的有期徒刑的，也适用取保候审。犯罪嫌疑人、其法定代理人、近亲属也可以为其申请取保候审。

人民法院、人民检察院和公安机关对犯罪嫌疑人、被告人取保候审最长不得超过十二个月，监视居住最长不得超过六个月。

在取保候审、监视居住期间，不得中断对案件的侦查、起诉和审理。对于发现不应当追究刑事责任或者取保候审、监视居住期限届满的，应当及时解除取保候审、监视居住。解除取保候审、监视居住，应当及时通知被取保候审、监视居住人和有关单位。

二、取保候审期限的计算

最高人民法院、最高人民检察院、公安部、国家安全部《关于取保候审若干问题的规定》(以下简称《规定》)第22条规定：受案机关决定继续取保候审的，应当重新作出取保候审决定;《人民检察院刑事诉讼规则》(以下简称《规则》)第56条规定：公安机关决定对犯罪嫌疑人取保候审，案件移送人民检察院审查起诉后，对于需要继续取保候审的，人民检察院应当依法对犯罪嫌疑人办理取保候审手续。取保候审的期限应当重新计算并告之犯罪嫌疑人;最高人民法院《关于执行〈中华人民共和国刑事诉讼法〉若干问题的解释》(以下简称《解释》)第75条规定：人民检察院、公安机关已对犯罪嫌疑人取保候审、监视居住，案件起诉到人民法院后，人民法院对于符合取保候审、监视居住条件的，应当依法对被告人重新办理取保候审、监视居住手续。取保候审、监视居住的时间重新计算。

2.取保候审的期限连续计算的规定：

高法《关于执行刑诉法若干问题的解释》第七十四条又有被取保人违反规定被依法没收保证金后，仍决定对其取保候审的，取保候审的期限应当连续计算。可见人民检察院、人民法院对取保候审的期限仅是违反规定重新取保的才连续计算，且在审判阶段不得对同一被告人重复采取取保候审措施，但在侦查阶段、审查起诉阶段并无明确的同一机关不得对同一犯罪嫌疑人重复采取取保候审措施的规定。

三、取保候审期限的限制

由于取保候审和监视居住这两种强制措施在实际执行中一旦被采取就难以撤销，使犯罪嫌疑人、被告人的人身自由长期受到限制，无法正常工作、学习和生活，不利于保障犯罪嫌疑人、被告人的合法权益。既不利于案件及时终结，也不利于打击犯罪和保护公民的合法权利，有损于法制的权威和严肃性。为此，相关法条规定：人民法院、人民检察院和公安机关对犯罪嫌疑人、被告人取保候审最长不得超过十二个月，监视居住最长不得六个月。这个期限是指人民法院、人民检察院和公安机关分别计算的最高期限。

三、取保候审期限到了怎么办

取保候审即将到期的，执行机关应当在期限届满十五日前书面通知决定机关，由决定机关作出解除取保候审或者变更强制措施的决定，并于期限届满前书面通知执行机关。执行机关收到决定机关的《解除取保候审决定书》或者变更强制措施的通知后，应当立即执行，并将执行情况及时通知决定机关。

被取保候审人在取保候审期间没有违反刑事诉讼法第五十六条的规定，也没有故意重新犯罪的，在解除取保候审、变更强制措施或者执行刑罚的同时，县级以上执行机关应当制作《退还保证金决定书》，通知银行如数退还保证金，并书面通知决定机关。
